The application of Bay Sand Company, Inc., applicant, and Anne Marie Kirk, owner, for a conditional use permit on fifty acres of land out of an 85 acre parcel located on a private road off of Muddy Cross Drive (Rte. 620), with tax parcel identification number 41-01-055. The purpose of the application is to allow for the expansion of an existing resource extraction operation to be permitted on the property.
The property in question has been used as agricultural fields and wooded areas for forestry and has never been developed. On several adjoining properties to the east is an existing borrow pit that originally received Conditional Use Permit (CUP) approval in 2009 which is largely reclaimed, as well as a subsequent expansion areas approved in 2018. The existing pit has been been mined continuously since the completion of a site plan following the original CUP approval. To the south is an area approved for a CUP for expansion of the existing borrow pit in 2017. The accompanying site plan was approved in 2018.
